Nancy Benoit Pictures Ruling Overturned

nancy_benoitOn Thursday a federal appeals court ruled that Hustler magazine did not have the right to print nude photos of Nancy Benoit. The family of Nancy Benoit took the magazine the appeals court to overturn a previous ruling that the magazine won claiming that printing the pictures was "newsworthy and in the public interest". The images in question were taken when Nancy was trying to break into the modelling industry but she requested that they be destroyed before her marriage to Kevin Sullivan.

The court said the following:

The 11th Circuit Court of Appeals ruling found that a notorious death doesn't give publishers a blank check to publish any images they wish -- including those not linked to a newsworthy event. Such a policy, the court warned, would mean that the entire life of any victim of a notorious slaying would instantly be open to public scrutiny.

I'm not too sure about the American privacy laws, but I do think that hustler printing the photos because of the fame that Nancy Benoit gained because of her death is a pretty shitty thing to do. I hope the Benoit family get a good payout and that her children can benefit from it.

  1. I read on some forums that Nancy and Kevin Sullivan used to take part in satanism acts in real life and it was more than a on screen gimmick.

FREEDOM OF SPEACH AND FREE PRESS They should have every right to post tasteless photos. If you don’t want stuff like this to haunt you don’t take photos. I don’t agree with it but freedom of speech/press is something I will always support.

I’m all for freedom of speech, but I think that printing naked photos of a woman because she was murdered has nothing to do with freedom of speech or free press.

It has everything to do with it. This is the same effect as not showing a MJ video because he is dead. If you have photos owned by someone else they have the right to print it.
